A correctional officer at West Virginia’s South Central Regional Jail was charged Sunday with two counts of imposition of sexual acts on incarcerated persons.
Stephen A. Elswick, 52, was released from jail Sunday after 10% of his $3,000 bail was posted on his behalf.
Andy Malinoski, a spokesman for the West Virginia Department of Homeland Security, confirmed Elswick’s arrest and said Elswick was no longer employed by the Division of Corrections and Rehabilitation.
The statute prohibits any person employed by the Division of Corrections and Rehabilitation or any person working at a correctional facility from having sexual intercourse, sexual intrusion or sexual contact with an incarcerated person.
The potential penalty is a fine up to $5,000 and a one- to five-year term of imprisonment.
A criminal complaint with details about the charge was not available Tuesday.
