A court has removed a challenge of a $5 million state grant for a newly launched Catholic school in Ohio from a fund that mainly has been used to support water and wastewater projects from its docket after previously finding the grant was unconstitutional.

After a July evidentiary hearing, Kanawha County Circuit Court Judge Richard Lindsay had put his ruling on hold for the West Virginia Water Development Authority grant for Steubenville, Ohio-based College of St. Joseph the Worker to allow the authority to provide documentation verifying the college would use funding only for constitutional purposes under the grant awarded through the Economic Enhancement Grant Fund.
